Let’s face it, copyright is a contentious topic, often misunderstood and misinterpreted.

According to the prevailing Australian and International copyright law, the copyright to a photograph belongs to the photographer who took the photograph in the first place.

However, given that our services ultimately provide our clients with photographs of their respective pets and best friends, it can be disconcerting when it comes to the copyright law and how it applies to these photographs.

With that in mind, let’s outline the rules of engagement when you enlist our services.

Puppy Love Photography, part of Chin Photography (we, us, our), retain the copyright to all photographs taken for our clients (clients).

We reserve the rights to make use of said photographs in our advertising and promotional material, including but not limited to publishing on our web sites, social media platforms (Facebook, Instagram, etc.) and print medias.

Privacy

Privacy is very important to us, we fully respect and understand clients’ concerns when it comes to publishing of said photographs in publicly accessible medium.

No potentially personal identifiable information of clients (for example, pet owner’s name and other personal detail, pet’s name) will be included in these publications.

Clients can opt-in to have some of these information included in our publications, for example the pet or pet owner’s name.

By default, sharing of potentially personal identifiable information is opt-out. In other words, no potentially identifiable information will be published unless clients explicitly opt-in and grant us the permission to publish these information. These options are included in our model release form to be completed by clients when enlisting our services.

Transfer of Copyright

Transfer of full copyright to clients can be negotiated if desired, the terms of the transfer will be determined on a case by case basis.

Usage Terms

Our services include high resolution image files as part of the deliverable to clients.

These image files, upon settlement of the transactions associated with the services rendered, are for clients to keep, forever and a day.

Clients are free to make use of these image files however they see fit, with some limitations and exclusions which are outlined below.

Commercial Use

  • Clients are permitted to make use of said photographs for commercial purposes, including but not limited to advertising and promotional materials.
  • We reserve the rights to impose additional charges when said photographs are intended for large scale distributions.

Derivative Work & Modification

Magazines & Periodical Publications

  • Clients are not permitted to publish said photographs or derivative work in magazines, periodicals, or any commercially circulated print media, without a licensing agreement or full transfer of copyright ownership.

Onsell & Stock Libraries

  • Clients are not permitted to onsell and profit from the said photographs or any derivative work.
  • Clients are not permitted to distribute the said photography or any derivative work in any stock library, including but not limited to Stock Photography Library.

Photography Competitions

  • Clients are not permitted to enter the said photographs or any derivative work into any competition, including but not limited to photography competitions, contests, challenges, etc.

Social Media Platforms

  • Clients are permitted to post and share said photographs on social media platforms, including but not limited to Facebook, Instagram, etc. Attribution to the copyright holder (us) is not required but would be greatly appreciated.
  • Clients are permitted to post and share derivative work from said photographs on social media platforms, including but not limited to Facebook, Instagram, etc. In this case attribution to the copyright holder (us) is expected, in the spirit of the Creative Common Attribution-ShareAlike 4.0 International (CC BY-SA 4.0) license.

Modification of Terms & Conditions

The Terms & Conditions are subject to modification without prior notice.
